CITIZEN COMMENTS
Joe Edwards, 2200 Highway 265, who owns three buildings on Old Missouri Road, said there is a lot of graffiti on the walls of these buildings and also the fuses have been pulled out of the fuse boxes this past week.
Mr. Edwards asked that City Council consider amending the ordinance that forces an owner to repair the damage immediately. He needs additional time because of the power going into the building. He also asked that the Police Department help catch the people doing this.

Mayor Sprouse announced that February 1-7, 2010, is “Drug Abuse Awareness Week”.
In conjunction with this, Chief O’Kelley said this Saturday, February 6, 2010, the Police Department will be hosting a collection and disposal site for anybody who might have old or expired prescription drugs, from 10:00 a.m. to 2:00 p.m. in the Police Department lobby.

Tom Smith, 106 Woodcliff Court, encouraged City Council to put the residential trash pick-up for the City of Springdale out for bid.
Randy Pounders, 290 Chantilly Avenue, General Manager for Roll-Off Service, said he is aware that the contract with Waste Management for residential trash service is up for renewal. He is asking that City Council give Roll-Off Services a chance to bid on this service.

Barry Bryant, representative of Fellowship Bible Church, reported on a service event held October 3, 2009 where 350 members of the church partnered with the City of Springdale on various projects throughout the day. There was a total of 2,100 hours of labor offered within a one day period.

Randy Mullikan announced a group of citizens in Springdale are holding a celebration called “Celebration Springdale” honoring the City of Springdale employees at no cost to the city. City Council members are invited to attend. It will be held at the Holiday Inn Convention Center.
Bob Arthur, Chairman of this year’s Leadership Springdale Class, expressed his appreciation for the NWA Economic Summit put on a couple of weeks ago by the Springdale Chamber of Commerce. He felt like it was a very candid, challenging and convincing event.

Mary Katherine Wilson, whose parents were both diagnosed with pancreatic cancer this past June, handed out purple ribbons for people to wear and raise awareness that November is recognized as “Pancreatic Cancer Awareness Month”.

POWER POINT PRESENTATION ON THE 5-YEAR MS4 STORM WATER PERMIT
Patsy Christie gave a power point presentation on the 5-Year MS4 Storm Water Permit. She explained the history of the program and that the City's current permit expired January 31, 2009 and that the new permit would be effective August 1, 2009 through August 1, 2014. Ms. Christie explained that the City's Notice of Intent was due on November 20, 2009 and required the submittal of a Storm Water Management Plan. She reviewed the purpose and scope of the plan and the permit requirement to address the six minimum control measures. She explained that Best Management Practices were also required to implement the control measures with measurable goals and a rationale for how and why each BMP and measurable goals was selected. She reported that the responsibility for implementing the program had been assigned to the Planning and Community Development Division but that a Stormwater Pollution Prevention Team with representatives for Planning, Public Works, Parks and Recreation, Building Permit and Inspection, Code Enforcement, Museum, Library, Fire and Police had been established to facilitate implementation throughout the City. The time line for implementation over the next five year period was also presented.

PROCLAMATION – “METHAMPHETAMINE AWARENESS MONTH”
Mayor Sprouse read a proclamation making the month of October 2009 “Methamphetamine Awareness Month” in the City of Springdale.
PRESENTATION ON U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) $1 HOUSING PROGRAM
Patsy Christie presented a slideshow on the U.S. Department of Housing and Urban Development (HUD) $1 Housing Program. HUD has a program called the $1 Homes Initiative which helps local governments to buy houses and foster housing opportunities for low and moderate income families and address their specific community needs by offering them the opportunity to purchase qualified HUD owned homes for a dollar. The families don’t get to buy the house for a $1 but the City gets to buy them for a $1.
Don Hancock was complimented for the outstanding job he has done in getting these homes rehabilitated along with the help of several volunteers.

Mayor Sprouse announced that there was a ribbon cutting and dedication for the newly expanded Luther George Grove Street Park on Grove Street. It has a new skate park and free Wi-Fi for people who want to use their computers.

SENIOR CITIZEN UPDATE
Lori Proud, Director of the Senior Citizen Center, reported they now have taken over the John Powell Senior Center and have moved all the exercise equipment in there. They are partnering with the Springdale Library who is going to help them set up computers and train some of the seniors to become computer teachers. There will also be a library area where books can be checked out. Rides are provided to seniors between the hours of 8:00 a.m. and 3:00 p.m. In July, 638 seniors were given rides; 2,180 seniors used the center for socialization; 1,626 ate a meal at the center and 3,519 meals were delivered to homebound seniors.

Noel Bastein, CGI Communications, was introduced to City Council. This week Mr. Bastein has been doing several videos of Springdale which will update the city’s virtual website tour.
PLAY DAY UPDATE
Parks and Recreation Director Rick McWhorter updated City Council on the first annual Play Day held on August 22nd at Murphy Park. It was estimated there were 1,500 – 1,800 people during the peak part of the afternoon. There were 16 different sponsors and 301 volunteers.

Tiffany Birkenbine, 3009 Pagosa Street, commented on the breed specific legislation being considered for pit bulldogs. She is opposed to the new proposal. She presented model legislation from the American Kennel Club for council to review.
Mayor Sprouse said this issue is going to be studied in the next few weeks and citizens will have opportunities to give input.

WASTE MANAGEMENT REPORT
Kevin Gardner, Waste Management, gave an update on new things happening at Waste Management. Springdale residents will now be able to purchase yellow and green bags from Fast-Trax, a convenience store on Shady Grove Road, Monday through Saturday, 6:00 a.m.-10:00 p.m. and Sunday, 7:00 a.m. to 10:00 p.m. They will try to find a northern location that will sell bags also.

AIRPORT GRANT
Wyman Morgan reported the Airport Commission had acquired 6.69 acres on the west side of the airport. The city received a grant from FAA to pay for 95% of the acquisition costs. Today he received a grant for the remaining 5% from the Arkansas Aeronautics Commission, paying for 100% of all costs of acquiring the property.

Mayor Sprouse recognized Jim Pierce who is retiring from the Springdale Building Inspection Department. He was employed by the Springdale Police Department for 20 years and then went immediately to work for the Code Enforcement Division where he worked almost 17 years
Mayor Sprouse recognized Susan Young and Heather Marie Wells, employees of Shiloh Museum. They announced that Shiloh has been awarded the 2008 Museum of the Year by the Arkansas Museums Association. More then 33,200 people were served in 2008, the largest number of people served in the last ten years. The museum also received national recognition for the museum podcast and online program offerings including awards from the American Association of Museums and the Southeastern Museums Conference. They also received an award for the best adult and family educational program of the year for the new site “I-Tunes You”.

James Shumate who works for the Arkansas Department of Health and is also a citizen of Springdale expressed concern with Animal Control in Springdale and animal bites not being reported appropriately. He is requesting that they start getting animal bite reports.

Alderman Overton said there has been a couple of attacks by pit bull dogs recently and he feels like it is time for the City Attorney to draw up an ordinance to ban pit bulls from the City of Springdale.
City Attorney Harper said there is a pending lawsuit on whether or not it is constitutional. He will check on it.
Alderman Overton said we need to make sure there is stricter enforcement and quicker response by animal control.
Mayor Sprouse announced free dental exams will be held May 8-9, 2009 at the Holiday Inn by local dentists.

Alicia Demarest, Griffin Company Realtors announced there will be an area clean-up on Saturday, April 18th, around Huckleberry, James, Sisters and Powell Streets. This is a combined effort of the Metro Board of Realtors, City of Springdale and Springdale Chamber of Commerce.
Mike Hicklin, Public Works Department, announced that on March 28, 2009, a group of volunteers gathered around Spring Creek and planted about 800 tree seedlings in observance of National Arbor Day. This was sponsored by the Illinois River Watershed Partnership.
Public Works Director Sam Goade introduced Delia Hawk, Executive Director of Illinois River Watershed Partnership, who expressed her appreciation to city employees for all their help.
Mayor Sprouse recognized Springdale Police Officers Mike Meadows and Jake Whorton for the work they did in detonating what appeared to be a pipe bomb at the Bank of America on Sunset Avenue.
Allison Williams from the high school division of a Community for all Generations invited everyone to a community action forum that will be held April 23, 2009, at 5:30 p.m. at the Jones Center Chapel.
CHAMBER OF COMMERCE REPORT
Perry Webb, Executive Director of the Chamber of Commerce, presented a report by Pizzuti Solutions on the research and analysis related to proposed development opportunities in Springdale. Using extensive retail market analysis, the report provides Springdale leaders with research and analyses intended to assist in the planning activities associated with more than 1,000 acres in and around Arvest Ballpark in southwest Springdale. The report outlines specific short-term tasks for moving proposed development opportunities forward.
Mr. Webb also presented a summary of a study that identifies and quantifies recent factors that have affected sales and use tax revenues returned to the City of Springdale by the office of the Arkansas State Treasurer.
The following results are those for which the results of the statistical analysis were relatively robust.
- The Streamlined Sales Tax Project is related to 1.1 to 2.1 percent of the decline in Springdale sales tax revenues.
- The relocation of the retailer Sam’s Club from Springdale to Fayetteville is related to between 6.0 percent to as much as a 20.7 percent of the observed decline in sales tax revenue accruing to the city.
- The Pinnacle Promenade retail complex is related to between 5.0 and 23.2 percent of the decline in Springdale sales tax revenues.
- The impact of operation of Arvest Park has an estimated positive impact on city sales tax collects of 3 percent of the decline. That is, operation of the ballpark offset the decline which would have been 3 percent greater. It is important to note that this result is preliminary and a better understanding of the impact of the ballpark will be possible with additional years of operation.

Mayor Sprouse recognized Brett Shulte, Professor of Journalism at the University of Arkansas, and his Reporting I Class, who are covering tonight’s City Council meeting.
Matt Tronzano, Kelly Kemp and Fadil Bayyari, Jones Center for Families representatives, talked to City Council about Spring Break activities and other events that will be held in the upcoming weeks. They want to continue the partnership they have with the City of Springdale.

Ron Mynett was present at Council to advocate the City of Springdale cleaning out Spring Creek and Clear Creek.
Several people were present at Council to discuss Ozark Regional Transit cutting the Bus 43 Route. They were very concerned with not having rides to and from work and other places in the city. A lot of them said this is their only transportation. They were asking that the City of Springdale not cut funding to Ozark Regional Transit and also asked when the route would be cut.
Mayor Sprouse told them they would need to talk to Phil Pumphrey, Director of Ozark Regional Transit, regarding when the route would be cut.
Alderman Stout explained that funding was not cut to Ozark Regional Transit; it was just not increased in this year’s budget. Mr. Pumphrey makes the decision on bus routes and how the money is going to be allocated. He suggested the riders talk to Mr. Pumphrey about this.
Mayor Sprouse said the City is going to continue to look for ways for funding but with the city’s budget this year there are a lot of hard decisions that will have to be made.
Alderman Jaycox asked that within the next 30 days the Mayor and City Council research and talk to residents and Mr. Pumphrey about these issues and try to come up with some sort of solution to this problem. A Finance Committee meeting will be held at 5:00 p.m. before the March 24, 2009 City Council meeting.

Alderman Overton said he has been receiving calls regarding graffiti on buildings. He would like Code Enforcement to follow up and take action as quickly as possible on cleaning the graffiti up.
Building Official Mike Chamlee said his department turns graffiti cases over to the Police Department.
Chief O’Kelley said there are some legal problems with cleaning up private property and they have also had a little trouble finding property owners.

STREET BOND REPORT BY STAFF ENGINEER BEN PETERS
Ben Peters reported on the progress of the Wagon Wheel Project, Phase I, and the Southern Corridor Project, Turner to Highway 265.
The Wagon Wheel Road Project was broken into four phases of construction in the amount of $4,713,025. The schedule was 450 days. There have been eight change orders on the project since inception increasing the amount $11,962. Forty days were added to the contract as part of the change orders. As of January 30th, Sweetser has completed about 4.2 million dollars worth of work, leaving about $500,000 of work to complete. The revised completion date after the change orders was February 8, 2009. The project is officially behind schedule. They are looking at substantial completion the second week of March. There is $750.00 a day penalty for the contractor.
The Southern Corridor Project, from Turner to Highway 265, was broken into three phases of construction in the amount of $3,600,000. The schedule was 635 days. Two change orders have been approved on this project for an increase of $15,000. Currently, no additional time has been added to this contract. As of December 22nd, Sweetser has completed $2,168,000 leaving $1.5 million work of work remaining. The substantial completion date on this project is March 13, 2009. It is anticipated this project will not be completed until the middle of April.

Oletha Gillean, 101 W. Edmondson, reported the city put a new sewer line along Turner and across her yard. The contractor broke her water line, but repaired it and replaced the driveway. When the water meter was moved in she incurred some damage which cost her $800.00 to repair. She feels like a portion of this cost should be shared with the city.

Perry Webb, Chamber of Commerce, presented a report on Springdale’s economy and progress during the tough times. He reported through a very active partnership, the City’s $400,000 contribution to the Chamber’s economic development initiatives over the last five years has enabled Springdale to maximize its investments in this area. Because the City’s contribution to economic development is less than 20 percent of the Chamber’s economic development budget, it is imperative to recognize the need for an ongoing partnership between the two entities. The Chamber is appreciative of the City’s contribution and sees this as a way to maximize benefit with the least amount of public dollar use. Private enterprise will always experience greater success and have more capability than a publicly funded initiative.

ICE STORM REPORT
Mayor Sprouse reported on the recent ice storm that hit the City of Springdale on January 27, 2009.
Proposals for bids on debris removal were distributed this afternoon. Bids are due in by 3:00 p.m. on Thursday, February 12th and then hopefully there will be a recommendation for the City Council on Friday, February 13th to consider a contract. If there is approval, then hopefully work will begin the following Monday.
Mayor Sprouse complimented city employees on the way they have stepped up to help get through this ice storm in so many areas. The local churches, school groups, civic groups and citizens of the City of Springdale have helped so much and have helped one another.

PROPOSED - EMERGENCY CLAUSE TO BE ADDED TO ORDINANCE NO. 4291 (AMENDING SECTION 2-127 OF THE SPRINGDALE CODE OF ORDINANCE; AMENDING THE POWERS OF THE PUBLIC FACILITIES BOARD)
Alderman Jaycox explained she was not at the January 29, 2009 meeting and she did not understand some of the wording in Ordinance No. 4291 that was adopted that night.
After discussion it was decided to not vote on the emergency clause. The Ordinance will be referred back to the Ordinance Commission to review some of the language in paragraph (c) regarding spending from the Capital Maintenance Account.

CIVIL SERVICE COMMISSION APPLICANTS
Wyman Morgan reported that after advertising for Civil Service Commission applicants, they received one applicant by the deadline and one after the deadline.
Alderman Overton recommended both applicants be interviewed at a personnel committee meeting which will be set at a later date.
COUNCIL COMMENTS
Alderman Overton encouraged City Council to drive by 3653 and 2983 Wagon Wheel Road where the owners are complaining about problems with the construction project and their homes.
PUBLIC MEETING – MASTER TRAIL PLAN
Alderman Core announced that a public meeting will be held on February 26, 2009, from 11 -2 and 4-7 in the council chambers to discuss the Master Trail Plan.
ADVERTISING AND PROMOTION COMMISSION APPOINTMENTS
Mayor Sprouse announced that he is appointing Rick Evans and Jesse Core to serve on the Advertising and Promotion Commission.

Dean Bitner, President of the Springdale Firefighters Association, said he is representing approximately 105 members in the City of Springdale. He told city council that there are a number of city employees right now are eligible for and are receiving government welfare benefits. We are now in very dire circumstances with the cost of living going up, a minimal cost of living raise last year and the proposal for no raise this year. He presented a city employees payroll direct deposit slip showing his expenses and how he barely makes enough and is receiving welfare benefits. He asked council to consider look at cutting the budgeted amounts for Ozark Regional Transit and the Chamber of Commerce or at least hold off on voting on their funding tonight until they know exactly where the money will be used. He encouraged council to take the lower paid people and give them a one time increase or do something better than what is being proposed.

Phil Pumphrey, Director of Ozark Regional Transit, introduced Matthew Daniels who spoke for riders who use the bus system. He asked that City Council continue to help fund Ozark Regional Transit for the services they provide in the City of Springdale. |

Jim Conner, Incoming President of the Northwest Arkansas Homebuilders Association, and Darrin Riggins, Springdale Builder, asked that City Council reconsider the driveway slope ordinance because it is creating a lot of hardship for the builders in the area as well as home owners. |

Chuck Redding, who owns several houses in the City of Springdale, commended the City of Springdale, especially the Public Works Department, for the job well done in cleaning up the City of Springdale after the recent storm. |

Larry Self, 608 Maple Drive, presented pictures of Maple Drive that is badly in need of repair. He cannot find where this street is on the list of streets that need to be improved. He asked council to consider fixing this street. |

Matthew Daniels, President of the National Federation of the Blind of Northwest Arkansas, announced that a blindness awareness walk at Har-Ber High School will begin at 8:30 a.m. on October 11, 2008. Also, Mr. Daniels asked that council consider adding back some bus routes to the Ozark Regional Transit System. |

Ron Mynatt, Callahan Mountain Road, told the City that Lake Springdale is a pending liability. The berm is leaking and eroding away very quickly. He also asked that City Council work towards getting the trails built around Springdale.
Mayor Van Hoose said the city staff is aware of the lake situation and is working on it. |

Walt Lassiter, Julio Road, reported he complained at the March 11, 2008 City Council meeting that the City of Springdale had not responded to code violation complaints by his neighbor against property located between the addresses of 3448 and 3263 Butterfield Coach Road. Progress has been made but some of the junk and tires remain. This has been going on for over a year. He has learned from city officials that some junk is allowed in agricultural zoned areas but not in residential zoned areas. He does not follow this thinking because an eyesore is an eyesore regardless of where you are at. Everyone in Springdale should be required to follow the same rules. He said he has called on City Council to change the ordinance that permits this sort of abuse and require property owners to remove anything that is unsightly, unsanitary or anything that may cause a distraction to drivers on the streets. |

Lowell Weatherby, who has family in Springdale, commented on the Dotson Memorial Building located at the corner of Pleasant and Emma Avenue, that is scheduled to be torn down in June of 2008. This building is on the historical registry and they would like to see the building saved. They would appreciate any help from the City.
Others that spoke in favor of saving the building were other family members Jan Allen Judy, Sam Allen and Cecilia Seay. |

Beverly Loomis, 3954 Salsbury, expressed concern with the construction on Walnut Grove Road. She was driving down the road and ran over debris in the road which punctured her tire and bent the rim on her car. She has been trying to talk with a representative with the construction company and has not received any satisfaction.
Mayor Van Hoose informed Ms. Loomis to turn over the information to his office and it will be turned over to the City Attorney’s office for investigation. |

Laurie Watkins, 1506 Backus, expressed concern with the procedures the Police Department uses regarding break-ins. Fingerprints are not taken unless there is over $5,000 worth of items stolen. Ms. Watkins encouraged people to contact the Police Department about preventive measures they can take to prevent break-ins in this community. |

Wayne Vanhook, 947 June Drive, encouraged City Council to not use Capital Improvement Funds to balance the 2008 Budget. He said this is not what was promised to the people in 1992 when the penny sales tax was passed. |

Swagg Gunther, 909 S. Thompson, asked that City Council consider accepting other materials to use for banners in the City of Springdale. He was cited for a banner last week and asked for some leniency and understanding on some of the sign issues like maybe allowing one banner.
Mayor Van Hoose told Mr. Gunther to present the proposed changes to the ordinance he would like to see and then give it to his City Council representative. |

Carol Kendrick, owner of Magnolia Gardens, told City Council that construction along the north side of Huntsville Avenue has caused more damage to the Magnolia Gardens property than projected. There is a dying tree and another expensive one at risk. Their business is dependent on curb appeal and the construction has left a mess on both the southern corridor and the main entrance to Magnolia Gardens. She asked that the City consider putting in a concrete retaining wall and curb to be constructed in the near future along the contracted border to preserve the remaining trees and reduce the effect of erosion on their property.

Steven Lewandowski, Griffin Company Realtors, said he understood that City Council will be looking at possible properties to be purchased for a city park. Griffin Company would like to offer their property located at 4497 Hylton Road, at a price of $35,000 per acre. |

There were several citizens in attendance who spoke in favor of the City of Springdale installing a stoplight at the intersection of Highway 71B and Arapaho Street. Those who spoke in favor were: Carrie Coburn, Bruno Paulino, Don Pitts, Terry Gunnels, Bill Wright, Gerald Johnston, James Skelton and Joe Edwards.
Alderman Overton asked that the Street and Capital Improvement Committee reconsider installation of a stoplight at their next Capital Improvements meeting. |

Paul Willlis, 4662 Stonecrest, asked that City Council reconsider making Wagon Wheel Road a Boulevard instead of the proposed five lane corridor. There were several residents from the area in attendance who stood up and showed support for this proposal. The primary issues for the change are safety, slowing down traffic and protection of property values. |

PRESENTATION OF PROPOSED SITE PLAN FOR THE BASEBALL PARK BY MARTIN DINITTO, HOK ARCHITECTS
Martin DiNitto, HOK Architects, presented the proposed site plan for the Baseball Park to be located at the southwest corner of Watkins Avenue and South 56th Street. They hope to have the site construction documents and have the first bid package on that on January 24, 2007. The bid package for the main ballpark will come out April 9, 2007.

The owners of the Pride of Texas Carnival asked City Council to consider changing the new Ordinance regarding carnivals to allow the permit to be for 10 days. That way it gives the carnival two weekends. The permit is now for seven days. |

DISCUSSION OF THE INTERSECTION IMPROVEMENTS AT CARLEY ROAD AND OAKLAWN FOR THE SOUTHERN CORRIDOR
Alderman Watson, Bond Committee Chairman, opened up discussion on the intersection improvements at Oaklawn and Carley Road (the Southern Corridor).
Alderman Watson explained he feels like the Bond Committee sometimes gets caught up with land acquisitions and does not have time to review plans of the corridors maybe as thoroughly as they should. The intersection of Oaklawn and Carley Road is one of those intersections. The question was raised is it better to widen Oaklawn west of Carley Road, where we are impacting residents on both sides of Oaklawn or would it be better to wait until it crosses east of Carley Road and gets into an open pasture and then begin the expansion from three lane to five lane on the east side of Carley Road.
Alderman Watson said the Bond Committee wanted to bring the intersection to the attention of the full Council to make sure that the design proposed is the one we want to go forward with before we start acquiring property.
City Engineer Ben Peters explained intersections are where bottlenecks always are so you always want more lanes at the intersection than you do in the straight areas. Widening the intersection is just good engineering practice.
The project has already been designed and is ready to go to bid.
After considerable discussion and remarks by Aldermen it was decided to leave the design of the intersection as it has been designed.
Alderman Watson asked that the Council and Bond Committee be provided with the designs of the Bond Projects. |
